What this document is
Gambitagem is an online chess service: games by invite, opponent search, tournaments, games against the computer, tactics puzzles and game review. These terms are the agreement between you and Gambitagem about the use of the site and the app.
This is a courtesy translation: if it differs from the original, the Portuguese version prevails.
By creating an account or using the service, you agree to these terms and to the Privacy policy. If you don't agree, don't use the service.
Your account
To play you need to create an account, with username, e-mail and password.
- You must be 13 or older. Those under 18 use the service with the permission of their parents or guardians.
- The account is personal: one person per account, and it can't be lent, sold or shared.
- The e-mail must be yours and in use: it is how the password is recovered.
- Keep your password safe. Whatever is done with your account is treated as done by you.
- The username is public. It can't offend, mislead or impersonate another person or the Gambitagem team.
Fair play
Gambitagem is only fun if the game is between people. So, in a game against another person, it is not allowed to:
- consult a chess engine, an endgame tablebase or any program that suggests moves;
- get help from another person during the game;
- lose or draw on purpose, arrange a result or use more than one account to tamper with a rating, yours or someone else's;
- use a program that plays for you or that automates the use of the service.
In daily games, as is customary in correspondence chess, you may consult books and opening databases. Engines are still not allowed.
To protect fair play, games may be analyzed by engine and reviewed by the team.
Getting along
Treat other players with respect. Harassing, threatening, offending or discriminating against anyone is not allowed, whether through the username, the messages the service allows or any other means.
Trying to break into accounts, exploiting flaws, overloading the service or collecting data about other players is not allowed either. If you find a flaw, tell the team.
You can block and report another player from the game screen. Reports are read by the team, and whoever reports is not identified to the reported person.
Moderation
When these terms are broken, the team may end games and tournaments, which in that case aren't rated, correct ratings and suspend the account, for a while or for good. The measure matches the seriousness of what happened.
If you think a measure was taken by mistake, write through the contact at the end of this document, and it will be reviewed by a person.
Your games and what is ours
The games you play are kept in your history and in your opponent's, and can be seen by other accounts, on your profile, in tournaments and by whoever has the game's address. You can download any finished game of yours as PGN.
If you delete the account, the games stay in the history of whoever played with you, without your name.
The brand, the design of the site and the app, the code and the pieces designed by Gambitagem are ours. Piece sets by other authors are used under their licenses, with the credit on the preferences screen.
What you send as feedback may be used to improve the service, with no obligation of payment.
Price
Creating the account and playing is free. In the future, some features may become part of a paid plan. If that happens, the price and the conditions are shown before you subscribe, and nothing is charged unless you do.
Availability and liability
The team works to keep the service up and working properly, but it may have failures, go down for maintenance and change over time: features may come, change or go.
A failure of the service may affect a game, a tournament or a rating. When that happens, we may correct the result or void the game.
To the extent the law allows, Gambitagem is not liable for indirect losses arising from the use or the unavailability of the service. Nothing here removes the rights the law grants you as a consumer.
Termination
You can delete your account whenever you want, in My account, inside the app. The Privacy policy explains what is deleted and what stays.
We may close an account that breaks these terms.
Changes to these terms
These terms may change. The date of the last change is at the top of this page, and a change that affects your rights is announced inside the app before it takes effect. Keeping on using the service after that is accepting the new version.
Law and jurisdiction
These terms follow Brazilian law. Any dispute is settled in the courts of the user's place of residence.
